Terms of Service

1. Welcome to U Funny

These Terms of Service ("Terms") constitute a legally binding End-User License Agreement ("EULA") between you and Run Horse Run LLC, doing business as U Funny ("we," "us," or "our"), governing your use of the U Funny mobile application and website (collectively, the "Service").

By creating an account or using U Funny, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use U Funny. By using the Service, you confirm that you meet this requirement.

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

U Funny is intended for individual, personal use. You may not use it for automated or commercial data scraping purposes.

3. Your Account

When you create an account, you agree to:

Provide accurate and truthful information
Keep your password secure and confidential
Notify us immediately of any unauthorized access to your account
Be responsible for all activity that occurs under your account

You may not create an account on behalf of someone else without their permission.

4. User-Generated Content & Zero-Tolerance Policy

U Funny allows you to create, upload, and share content including comedy bits, set lists, videos, critiques, reviews, profile information, and other materials ("User Content").

You own your content. By uploading or sharing content on U Funny, you grant us a limited, non-exclusive, worldwide license to store, display, reproduce, and deliver that content within the Service solely to provide functionality to you and other users. You can delete your content at any time.

U Funny maintains a strict zero-tolerance policy for objectionable content and abusive behavior. This includes, but is not limited to: hate speech, harassment, bullying, threats of violence, sexually explicit material, content that exploits minors, doxxing, impersonation, and any content that promotes illegal activity.

By using U Funny, you agree that you will not post, upload, or share any content that:

Contains hate speech, slurs, or content that demeans individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Threatens, harasses, bullies, or intimidates any individual
Contains sexually explicit or pornographic material
Promotes or glorifies violence, self-harm, or terrorism
Exploits or endangers minors in any way
Shares personal information of others without their consent (doxxing)
Impersonates another person, comedian, or public figure
Infringes on the copyright, trademark, or intellectual property rights of others
Contains spam, scams, or deceptive content
Promotes illegal activities or substances
Contains malware, viruses, or any harmful code

Enforcement: Violations of this policy will result in immediate content removal and may lead to temporary suspension or permanent termination of your account, at our sole discretion. Severe violations (threats, exploitation of minors, illegal activity) will be reported to the appropriate law enforcement authorities.

5. Content Moderation & User Safety

To maintain a safe community, U Funny employs the following measures:

Automated content filtering: We use automated systems to detect and filter objectionable content before it is published
User reporting: All users can flag and report objectionable content or abusive behavior directly within the app using the report feature
User blocking: Users can block other users at any time. Blocking immediately removes all content from the blocked user from your feed and prevents future interaction
Developer review: All reports and blocks are reviewed by our team. When a user is blocked, our team is notified and the reported content is reviewed for policy violations
Content removal: Objectionable content will be removed promptly upon discovery or report, and the user responsible will be notified of the violation
Account actions: Users who repeatedly violate these Terms will have their accounts suspended or permanently terminated

        If you encounter objectionable content or abusive behavior, please report it immediately using the flag or report option available throughout the app. We review all reports within 24 hours.
      

6. AI Comedy Coach

U Funny includes an AI Comedy Coach feature powered by third-party AI technology. By using this feature, you understand that:

AI-generated feedback is for entertainment and creative inspiration only
Suggestions are not guaranteed to be accurate, appropriate, or suitable for all audiences
You are responsible for any content you perform publicly based on AI suggestions
Content you submit to the AI Coach may be processed by our AI provider to generate responses

7. Premium Subscription

U Funny offers a free tier and an optional Premium subscription. Premium features may include additional AI coaching sessions, advanced analytics, and other benefits as described in the app.

Subscriptions are billed through the Apple App Store or Google Play Store
Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
Refunds are handled in accordance with Apple's and Google's refund policies
We reserve the right to modify Premium pricing with reasonable advance notice

8. Our Rights

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Remove any content that violates these Terms, our Community Guidelines, or that we deem harmful to the community, without prior notice
Suspend or permanently terminate accounts that violate these Terms
Cooperate with law enforcement authorities regarding illegal content or behavior
Update these Terms at any time with notice to users

9. Disclaimer of Warranties

U Funny is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We are not responsible for the accuracy of open mic listings, venue information, or user-generated content posted on the platform.

10. Limitation of Liability

To the fullest extent permitted by law, Run Horse Run LLC and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or damages resulting from content posted by other users.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of U Funny will be resolved through binding arbitration rather than in court, except where prohibited by law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or by email. The "Last updated" date at the top will always reflect the current version.

Continued use of U Funny after changes are posted constitutes your acceptance of the updated Terms.
